Terms & Conditions
By making any payment to Mkhonto Tombstones or using our services, you agree to the following Terms and Conditions. These terms are binding and enforceable under South African law.
1. Payments & Deposits
1.1. A deposit of 30% of the total cost is required to initiate any order.
1.2. Manufacturing will only begin once 50% of the total amount has been paid.
1.3. Full payment (100%) must be made and must reflect in our bank account before installation.
1.4. We do not offer credit, cash on delivery, or payment after installation under any circumstances.
2. Installation Terms
2.1. Installation will only take place after full payment has been received.
2.2. If full payment is not received at least one day before the scheduled installation, the installation will be postponed.
2.3. We do not install tombstones during rainy weather. In such cases, installation will be delayed by 1 to 2 days to allow the ground to dry.
2.4. Mkhonto Tombstones is not liable for delays caused by weather, cemetery access issues, or any other factors beyond our control.
3. Lay-By Agreement
3.1. A 30% deposit is required to start a lay-by agreement.
The full balance must be paid within 12 months from the date of the agreement.
3.2. If the lay-by is cancelled, 10% of the total amount paid will be retained by Mkhonto Tombstones as an administration fee.
3.3. Manufacturing will only commence once 50% of the total amount has been paid.
3.4. Installation will only take place once 100% of the amount has been received.
4. Cancellations, Refunds & Custom Orders
4.1. Once a personalised tombstone has entered the production phase, no refunds will be issued under any circumstances.
4.2. Due to the customised nature of our products, all deposits and partial payments are non-refundable.
4.3. If a customer wishes to cancel an order, the cancellation must be made before production starts. Any cancellations made after production has begun will not qualify for any refund.
4.4. If you are unable to pay within the agreed timeframe, please urgently contact us for assistance. We may at our discretion consider a payment arrangement based on your situation.
4.5. Any customisation changes requested after production has started may result in additional charges and are subject to approval depending on the stage of production.
5. General
5.1. All timelines given for production or installation are estimates and may change due to weather, payment delays, or material availability.
5.2. Mkhonto Tombstones will not be held responsible for any delay or non-performance resulting from factors beyond our control.
6. Additional Terms
6.1. Customer Responsibilities & General Provisions
6.1.1. Cemetery Access & Permissions
It is the customer’s responsibility to ensure that all necessary permissions, documents, or cemetery fees are arranged prior to the scheduled installation. If access is denied or documents are not in place on the day, the installation will be rescheduled, and an additional call-out fee may apply.
6.1.2. Site Preparation
The customer must ensure that the grave site is clearly marked, accessible, and ready for installation. Mkhonto Tombstones is not liable for incorrect installation if the plot location is unclear or inaccurate.
6.1.3. Design Confirmation & Final Approval
Where applicable, a draft layout or design (including inscriptions or photos) will be shared for approval. Once approved, no changes can be made without possible extra charges, especially if production has already started.
6.1.4. Workmanship Guarantee
We provide a 6-month workmanship guarantee on all installations. This covers issues such as poor alignment, tilting, or structural defects caused by our team. It does not cover damage due to weather conditions, vandalism, natural disasters, or interference by third parties.
6.1.5. Natural Materials Disclaimer
Note that products made from natural stone may have natural colour, grain, or texture variations. These are normal characteristics and not considered defects.
6.1.6. Communication & Customer Information
All official updates and communication will be sent via SMS, WhatsApp, phone call, or email. The customer is responsible for ensuring that their contact details are correct and updated throughout the process.
